How to get a Residence Permit When You Buy Property in Thailand
The Thai government recently enacted a new law allowing investors who bring in 3.5 million Baht or more to invest in Thailand to apply for a Residence Permit.
The permit allows foreigners to stay stay in the Kingdom for one year on a yearly renewable residence permit without having to leave the country at renewal time. The foreign investor must supply the following documents and show proof that they have brought in 10 million Baht or more to invest:
Original application form (TM.8); copies not accepted.
Certificate that the foreigner (over 14 years of age) has no criminal record. The certificate must be officially certified by the Thai consulate in the applicant's country, or at the applicant's national embassy in Thailand.
Copy of the family status certificate; for example, marriage certificate or registration, birth certificate, house registration. These documents must be officially certified as in #2.
Copy of the applicant's educational certificates.
A copy of the applicant's work permit(s), every single page that contains information, and a letter from their work place signed by an authorized person (if applicable).
A copy of the applicant's annual personal income tax form (por ngor dor 91 or 90) with receipts for the previous 3 years before application submission year, officially certified by the Revenue Department (if applicable).
A copy of the applicant's monthly income tax form (por ngor dor 1), with receipts from the beginning of the submission year of application (January) until the previous month of application submission, which must be certified by the company's authorized person (if applicable).
Certificate of money transfer from abroad to any bank in the Kingdom of Thailand for the total amount of at least 10 million Baht which must be issued by the bank where the transaction occurred. The applicant's investment evidence to prove that he/she has made an investment in Thailand in the following ways:
Invest in a limited company or a public company under the condition that he/she must hold the investment for 3 consecutive years since the day he/she obtains the residence permit. Must supply the following documents:
Certificate of juristic person registration which is issued and officially
certified by the Ministry of Commerce within the previous 3 months before the application submission date.
List of the shareholders which is issued and
officially certified by the Ministry of Commerce within the previous 3 months before the application submission date.
Copy of the value added tax (VAT)
or the specific business tax registration; phor phor 01, or phor phor 09, or phor phor 20, and a copy of the financial statements (balance sheet,
profit and loss statement), together with phor ngor dor 50 (company income tax form) and receipts for the previous 3 years before the application
submission year.
Invest in government or state enterprise bonds under the condition that he/she cannot transfer his/her ownership or pawn either bonds
or ownership for 3 consecutive yeas from the day he/she obtains a residence permit. Must submit the following documents:
Certificate letter for the purchase of government or state enterprise bonds issued by any bank in Thailand.
Copy of government or state enterprise bond certificates, together with
the originals.
Invest in the Thai stock market (ordinarey shares, debentures). Investment units which must be approved or certified by the Security and
Exchange Commission under the condition that heshe canot either transfer or pawn his/her shares or ownership for 3 consecutive years from the day
he/she obtains the residence permit. Must submit the following documents:
Certificate letter for the purchase of shares and proof of investment with
the original.
Map of residence and place of work.
Copy of every single page of the applicant's passport to indicate the duration of stay in the Kingdome
for at least 3 consecutive years.
Personal information sheet and the applicant's portfolio which includes detailed information about family background,
knowledge and ability, working experience, special abilities, social work, work place, residence, together with photo (using an A4 document
folder).
Additional documents which the immigration officer may ask for.
Remarks:
Copies of personal documents must be certified by the person to whom the documents belong.
Copies of the company's documents must be certified by the company's authorized person.
Documents which are in foreign language must be translated into Thai and the translation must be certified ty the translator with the translator's information (name, telephone number) which can be verified later.
