BOI & MOI Privileges Granted to Manufacturing/Export Investors

This is a brief summary of the promotional privileges the Board Of Investment (BOI) gives to investors coming to Thailand to set up manufacturing facilities in approved industrial zones and export their finished products. The BOI is a government body set up to give special privileges to overseas investors in industry and software production. Any company contemplating investing in Thailand should be aware of the benefits BOI offers.

1. Exemption of import duty on machinery
2. Corporate income tax exemption for 8 years;
3. Exemption of import duty on raw or essential materials usedin the manufacturing of export products for 5 years
4. 75% reduction of import duty on raw and essential materials used in for domestic sales for 5 years
5. Permission for foreign investors to own land
6. Permission for foreign technicians, experts and their spouse or dependents to work and stay in Thailand
7. Permit to remit abroad foreign currency
8. Other special privileges as follows:
   Reduction of corporate income tax by 50% for 5 years after the exemption period
   Double deduction from taxable income of water, electricity and transport costs for 10 years from the date of the sales
   Deduction from the net profit of 25% of the costs of installation or construction of the project's infrastructure facilities

**On August 1, 2000, Board of Investment of Thailand (BOI) announced a new Thailand investment promotion scheme. Some investment incentives have been revised and canceled. The provinces of Phuket and Rayong have been moved from Investment Promotion Zone 3 to Zone 2.

In order to encourage more investors to set up factories in industrial zones, BOI offers special privileges for projects setting up in industrial zones and submitting an application before December 30, 2004.

Although Rayong Province has moved to BOI zone 2, investors who set up before December 30, 2004 can still receive the previous package of BOI Zone 3 Privileges.

Ministry of Industry (MOI) Privileges:

These privileges are only available to projects in designated MOI Industrial Zones. These are shown on the BOI website.

1. Exemption from applying for factory operation and expansion licenses (Only advance notice is required)
2. Exemption from applying for factory construction license. (Only in cases where the largest single building is not larger than 10,000 square meters, otherwise a license is required)
